Terms of Service

These terms are the agreement between you and Quirl. They cover what you can expect from the service, what we expect from you, and how billing works. We've tried to write them in plain English. If something here is unclear, email [email protected] and ask.

Accepting these terms

By creating a Quirl account or using the service, you agree to these terms and to our Privacy Policy. If you don't agree, don't use Quirl.

Who you're contracting with

Quirl is operated by Quirl LLC, a California limited liability company. You can reach us at [email protected] or by mail at Quirl LLC, 2108 N St, Ste N, Sacramento, CA 95816, USA.

Who can use Quirl

You must be at least 13 years old to use Quirl. If you're under 18, you may only use it with the involvement of a parent or guardian who agrees to these terms. Quirl surfaces news from sources you choose and doesn't filter for age-appropriate content.

You need an account, and you need an active subscription to use the reading features. One person per account.

What Quirl does

Quirl gathers articles from the topics and feeds you follow, writes a short summary of each, estimates how significant each one is, and presents them as a feed and as an optional email newsletter. Every item links to the original article at its source.

We may change, add, or remove features over time. We may also stop offering the service entirely — if we do, we'll give you reasonable notice and stop charging you.

Your account

Keep your password to yourself and let us know promptly at [email protected] if you think someone else has access to your account. You're responsible for activity under your account. Give us an email address you actually use — it's how we send you your newsletter, receipts, and account notices.

Acceptable use

Please don't:

  • Scrape, crawl, or bulk-download Quirl, or access it through automated means we haven't approved.
  • Republish or resell our summaries, rankings, or newsletters as your own product.
  • Share your account with other people, or resell access to it.
  • Try to break, overload, or probe the security of the service, or access other users' data.
  • Add feeds you don't have the right to access, or use Quirl to get around a publisher's paywall.
  • Use Quirl to break the law or infringe anyone's rights.

We may suspend or close an account that does these things.

Articles and publishers' rights

The articles Quirl shows you belong to the publishers who wrote them, not to us. We don't claim ownership of any third-party article, headline, image, or excerpt that appears in the service. Copyright in that material stays with its owner, and your use of it is subject to the rights of that owner.

Quirl is a reading tool for your own personal use. Don't redistribute the article text, images, or our summaries of them.

We don't review articles before they appear, and including an article isn't an endorsement of it or a statement that it's accurate. Opinions in the articles are the publisher's, not ours. We may remove any article, feed, or source from the service at any time, for any reason.

Every item in Quirl is attributed to its source and links out to the original. If you're a publisher and you'd like your content removed from Quirl, email [email protected] and we'll take care of it promptly — you don't need to send a formal legal notice.

AI summaries, and what they can't do

Quirl uses AI in a deliberately narrow way: to summarize articles that already exist and to estimate how important each one is. Quirl never writes news. Everything in your feed and newsletter comes from a real article published by a real source, and the order articles appear in is decided by our own code, not by a language model.

Summaries are generated automatically and can be wrong. They may be incomplete, may omit important context, may misstate what an article said, or may emphasize the wrong thing. An importance score is an automated guess, not editorial judgment.

Treat a Quirl summary as a pointer, not as the news itself. The original article is always the authority, and every post links to it. Don't rely on a summary for anything that matters without reading the source. Nothing in Quirl is financial, legal, medical, or other professional advice.

Copyright complaints

If you believe material in Quirl infringes your copyright, send a notice to our designated agent at [email protected], or by mail to Quirl LLC, 2108 N St, Ste N, Sacramento, CA 95816, USA, Attn: Copyright Agent.

Please include:

  • Your signature (electronic is fine) as the owner or an authorized agent.
  • Identification of the copyrighted work you say was infringed.
  • The material you want removed and where to find it in Quirl.
  • Your contact information.
  • A statement that you believe in good faith the use isn't authorized by the owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information is accurate and that you're authorized to act for the owner.

We'll remove or disable material expeditiously in response to a valid notice. If your material was removed and you believe that was a mistake, you can send a counter-notice with the corresponding information and we'll follow the process in section 512 of the Copyright Act.

Repeat infringers. We will terminate, in appropriate circumstances, the accounts of users who repeatedly infringe copyright.

Subscriptions and billing

Quirl is a paid service with a single Premium plan. There is no free tier.

If you subscribe on the web, payment is processed by Stripe:

  • $7.00 per month, or
  • $60.00 per year.

If you subscribe in the iOS app, payment is processed by Apple:

  • $6.99 per month, or
  • $59.99 per year.

YOUR SUBSCRIPTION RENEWS AUTOMATICALLY AT THE END OF EACH BILLING PERIOD — EVERY MONTH FOR A MONTHLY PLAN, EVERY YEAR FOR AN ANNUAL PLAN — AND YOU WILL BE CHARGED THE THEN-CURRENT PRICE EACH TIME, UNTIL YOU CANCEL. YOU CAN CANCEL AT ANY TIME.

Prices are in U.S. dollars and don't include any taxes that may apply. If a payment fails, your access may be suspended until it goes through.

Free trial

NEW SUBSCRIBERS GET A 7-DAY FREE TRIAL. WE COLLECT YOUR PAYMENT DETAILS UP FRONT. UNLESS YOU CANCEL BEFORE THE TRIAL ENDS, IT CONVERTS AUTOMATICALLY INTO A PAID SUBSCRIPTION AND YOU WILL BE CHARGED THE PRICE OF THE PLAN YOU CHOSE.

The trial is available once per person. If you've subscribed before, you'll be billed immediately rather than getting another trial. On iOS, cancel at least 24 hours before the trial ends to avoid being charged.

Cancelling

Where you cancel depends on where you subscribed, and each can only be cancelled in its own place:

  • Web subscriptions: cancel any time from your account settings. No email or phone call required.
  • iOS subscriptions: cancel in the Settings app on your iPhone — tap your name, then Subscriptions. Apple controls these, and we cannot cancel one for you.

Cancelling stops the next renewal. You keep access until the end of the period you've already paid for, and we won't charge you again.

Note that deleting your Quirl account does not cancel an App Store subscription — cancel that with Apple first, or Apple will keep billing you.

Refunds

Web subscription fees are non-refundable, including for partial periods. You can cancel any time and keep access through the end of the period you paid for. The free trial exists so you can evaluate Quirl before paying anything. We may still choose to give a refund in a particular case, but we're not obliged to, and doing it once doesn't commit us to doing it again.

Purchases made through Apple are refunded by Apple, not by us. Request one at reportaproblem.apple.com. We have no ability to issue refunds for App Store purchases.

Nothing here takes away a refund or cancellation right that the law where you live gives you and doesn't let you waive.

Price changes

We may change our prices. If a change affects your subscription, we'll give you clear notice by email at least 7 days and no more than 30 days before the new price takes effect, along with how to cancel. The new price applies from your next renewal. If you don't want to pay it, cancel before then. For subscriptions billed by Apple, Apple handles price-change notice and consent under its own rules.

Purchases through the App Store

If you subscribe inside the iOS app, Apple processes the payment and your purchase is also governed by Apple's Media Services Terms and by Apple's Licensed Application End User License Agreement, which governs your licence to use the app itself. Apple's standard EULA is available at apple.com/legal/internet-services/itunes/dev/stdeula.

Apple is not responsible for Quirl, its content, or supporting it — we are. Apple is not a party to this agreement between you and us. Billing, cancellation, and refunds for App Store purchases go through Apple, as described above.

Gifts

Quirl subscriptions can be bought as a gift. A gift code is redeemable once, by whoever holds it, and gives that account a set period of access starting on the day it's redeemed — not on the day it was bought. Gift codes don't expire. Gift access doesn't renew and isn't charged again; it simply ends when the period runs out. Gift purchases are non-refundable once the code has been sent.

What we own

Quirl — the software, the design, the name and logo, and the summaries and rankings we generate — belongs to us. These terms don't give you any rights to it beyond using the service as intended. You may not copy, modify, reverse engineer, or create derivative works from it.

What you add

You can add your own feeds, create topics, and describe what you want to read. You keep ownership of what you submit, and you give us permission to store and process it in order to run the service for you. You confirm you have the right to submit any feed you add.

Feeds are shared across Quirl, so a feed you add may be used to serve other people who follow the same source, and it stays in the catalogue if you close your account. If you send us feedback or suggestions, we can use them freely without owing you anything.

Ending things

You can stop using Quirl whenever you like, cancel your subscription from wherever you bought it, and delete your account from your account settings.

We may suspend or terminate your account if you break these terms, if your payment fails, or if we're required to by law. If we terminate your account without cause while you have time left on a paid period, we'll refund the unused portion. Deleting your account removes your personal data as described in the Privacy Policy, and it can't be undone.

Disclaimer

QUIRL IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE SPECIFICALLY DO NOT WARRANT THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF ANY SUMMARY, IMPORTANCE SCORE, RANKING, OR NEWSLETTER PRODUCED BY THE SERVICE, OR OF ANY THIRD-PARTY ARTICLE OR SOURCE IT DRAWS ON. SUMMARIES ARE MACHINE-GENERATED AND MAY BE INACCURATE OR MISLEADING. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of liability

TO THE EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF QUIRL.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO QUIRL WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limits don't apply to fraud, willful misconduct, gross negligence, or anything else that the law does not permit us to limit or exclude — including any liability or right under consumer-protection law that you cannot waive. Some jurisdictions don't allow certain exclusions, so parts of this section may not apply to you.

Indemnification

If your use of Quirl, your breach of these terms, or content you submit causes a third-party claim against us, you agree to defend and indemnify us against it, including reasonable legal fees. We'll tell you promptly about any such claim and let you control the defense, provided any settlement doesn't create an obligation for us.

Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in California, and we each consent to the jurisdiction of those courts.

There is no arbitration clause here and no class-action waiver — if we have a dispute, either of us can go to court, including small claims court. If you live somewhere whose law gives you the right to bring a claim locally, or applies mandatory consumer protections, this section doesn't take that away.

Legal notices

Formal legal notices to us must be sent to [email protected], or by mail to Quirl LLC, 2108 N St, Ste N, Sacramento, CA 95816, USA, Attn: Legal. Copyright notices have their own designated agent — see Copyright complaints above.

We may give you notice by email to the address on your account or through the service itself, and a notice is treated as received when we send it.

Changes to these terms

We may update these terms. When we do, we'll change the date at the top, and for material changes we'll give you notice by email or in the app before they take effect. If you keep using Quirl after a change takes effect, that's your acceptance of it. If you don't accept a change, cancel your subscription and stop using the service. Changes aren't retroactive.

For California users

Under California Civil Code section 1789.3, California users are entitled to this notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Everything else

If a part of these terms turns out to be unenforceable, the rest still applies. If we don't enforce something right away, we haven't given up the right to enforce it later. You can't transfer your account or these terms to someone else; we may transfer them if the business is sold or reorganized. These terms, together with the Privacy Policy and Cookie Policy, are the whole agreement between us about Quirl. We're not responsible for failures caused by things outside our reasonable control.
